Terms of Service
These Terms of Service (the “Terms”) form a binding agreement between you and FXMARE (“FXMARE”, “we”, “us” or “our”) and govern your access to and use of the FXMARE website, applications, data, tools and content (together, the “Service”). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1.Acceptance of these terms
By accessing or using the Service in any way — including browsing pages, viewing market data, using calculators or creating an account — you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, Risk Disclosure and How We Make Money notice, each of which is incorporated into these Terms by reference. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2.Eligibility & who may use FXMARE
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and legally able to enter into a binding contract to use the Service. The Service is intended for general informational use and is not directed at any person in a jurisdiction where its publication or availability is prohibited or where FXMARE would be subject to registration requirements it does not meet.
You are responsible for ensuring that your use of the Service, and any trading you undertake with a third-party broker, complies with the laws applicable to you. Some financial products discussed on FXMARE are restricted or prohibited for retail clients in certain countries.
3.The service we provide
FXMARE is an information and tools platform for traders and investors. It provides market data (live and delayed), an economic calendar, news and analysis, sentiment data, calculators, a trading journal and broker comparison information.
FXMARE is not a broker, exchange, bank or money-transmitter. We do not hold your money, execute trades, custody assets or provide brokerage, investment, legal, tax or accounting services. Any trading takes place at a separate, independently regulated third party that you choose, under that party's own terms.
4.Accounts & registration
You may create an account with an email address and password, or through a third-party identity provider such as Google. Signing in with a provider links that provider’s account to your FXMARE account; if the email address already belongs to an FXMARE account, the two are linked rather than duplicated. You remain responsible for the security of whichever account you use to sign in, and for everything done under your FXMARE account.
Some features (such as saving entries in the trading journal) may require an account. You agree to provide accurate, current and complete information when registering and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Notify us promptly at [email protected] if you suspect any unauthorised use of your account. We are not liable for any loss arising from unauthorised use of your account where you have failed to keep your credentials secure. You must not share your account, create accounts by automated means, or use another person's account without permission.
5.Acceptable use
You agree not to, and not to permit anyone else to:
- use the Service for any unlawful, fraudulent or abusive purpose, or to breach any applicable law or regulation;
- scrape, harvest, crawl, frame, mirror or systematically extract data or content from the Service except as expressly permitted, or use automated tools that place an unreasonable load on our infrastructure;
- copy, resell, redistribute or commercially exploit market data or other content without our prior written consent or that of the relevant data provider;
- attempt to gain unauthorised access to the Service, other accounts, or our systems or networks, or probe, scan or test their vulnerability;
- introduce malware, interfere with or disrupt the integrity or performance of the Service, or circumvent any security or rate-limiting measures;
- reverse engineer, decompile or disassemble any part of the Service except to the extent that restriction is prohibited by law;
- remove, obscure or alter any proprietary notices, or impersonate any person or misrepresent your affiliation;
- post or transmit content that is defamatory, infringing, obscene, harassing, misleading (including market manipulation or pump-and-dump promotion) or otherwise objectionable.
6.Intellectual property
The Service and all of its contents — including software, text, graphics, layout, logos, the FXMARE name and brand, compilations of data, charts and the look and feel — are owned by FXMARE or its licensors and are protected by intellectual-property and other laws. Market data is provided by third-party data vendors and remains their property.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial purposes. All rights not expressly granted are reserved. You may not use our trademarks without prior written permission.
7.Your content
The Service may let you submit content such as journal entries, notes, watchlists or feedback (“Your Content”). You retain ownership of Your Content. You grant FXMARE a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and process Your Content solely as needed to operate, provide and improve the Service.
You are solely responsible for Your Content and represent that you have the rights to submit it and that it does not violate these Terms or any law or third-party right. We may remove content that we reasonably believe breaches these Terms. Where you submit feedback or suggestions, you grant us the right to use them without restriction or obligation to you.
8.Third-party links, brokers & ads
The Service contains advertisements, sponsored placements and links to third-party websites and services, including brokers. These are provided for convenience and information. We do not control, endorse or assume responsibility for any third party, its content, products, services or practices, and your dealings with any third party are solely between you and that party.
FXMARE earns revenue from advertising and from affiliate commissions when you open an account or take certain actions through links marked as advertising or sponsored. This is explained in full in our How We Make Money notice. Such commercial relationships do not change the obligations FXMARE owes you under these Terms, and you should review any third party's own terms and risk warnings before engaging with it.
9.No financial advice & data
Nothing on the Service is investment, financial, legal, tax or other professional advice or a personal recommendation. The Service does not consider your individual circumstances. You are responsible for your own decisions. See our Risk Disclosure for the full risk warning.
Market data and other information may be delayed, inaccurate or incomplete and is provided on an “as is” basis. You must not rely on it for time-critical decisions or as the sole basis for any trade. We and our data providers are not liable for any reliance you place on such data.
10.Disclaimers & warranties
To the fullest extent permitted by law, the Service and all content are provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, title and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free or free of harmful components, that defects will be corrected, or that any data, results or content will be accurate, complete, reliable or current. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you, and nothing in these Terms limits rights you have as a consumer that cannot be excluded by law.
11.Limitation of liability
To the fullest extent permitted by law, FXMARE and its officers, employees, agents, suppliers and data providers will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, revenue, data, goodwill, trading losses or anticipated savings, arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility of such damages.
In particular, FXMARE is not responsible for any trading or investment losses you incur, which result from your own decisions and from market conditions outside our control. To the extent we are found liable despite the above, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us, if any, for the Service in the twelve months before the event giving rise to the claim, or (b) US$100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence or for fraud.
12.Indemnification
You agree to indemnify, defend and hold harmless FXMARE and its officers, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with your use of the Service, Your Content, your breach of these Terms, or your violation of any law or third-party right.
13.Suspension & termination
You may stop using the Service at any time and, where you hold an account, request its closure. We may suspend or terminate your access to all or part of the Service at any time, with or without notice, if we reasonably believe you have breached these Terms, to comply with law, or to protect the Service or other users.
On termination, the licences granted to you end and you must stop using the Service. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnity and governing law — will continue to apply.
14.Governing law & disputes
These Terms and any non-contractual obligations arising out of them are governed by the laws of England and Wales, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection laws of the country where you live, you and FXMARE agree that the courts of England and Wales will have jurisdiction over any dispute, although we may also seek to enforce these Terms in the courts of the country where you are located.
Before bringing any formal claim, you agree to contact us at [email protected] so we can try to resolve the matter informally.
15.Changes to these terms
We may update these Terms from time to time to reflect changes to the Service, our business or the law. When we make material changes we will update the “last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you should stop using the Service.
16.General
- Entire agreement. These Terms, together with the policies they reference, are the entire agreement between you and FXMARE regarding the Service.
- Severability. If any provision is held unenforceable, the rest of the Terms remain in full force and effect.
- No waiver. Our failure to enforce any right or provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
17.Contact
